This Privacy and Cookies Policy sets out the rules for the processing and protection of personal data and the use of cookies and other technologies such as: : Google Analytics, Facebook Pixel in connection with the Users’ use of the Website, the Shop and the social media profiles operated by the Administrator

§1 Definitions

For the purposes of this privacy policy, the following terms shall have the following meanings:

3. Shop – online shop available at https://meadowstale.com/en/shop
4. User – any entity that browses the content of the Website.
5. RODO – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC

§2 Personal data

1. The Administrator is the controller of the User’s personal data within the meaning of the RODO.
2. The User may provide his/her personal data to the Administrator, inter alia, by means of forms available on the Website and the Shop, as well as solutions such as instant messaging and social media profiles.
3. The legal basis for the processing of Users’ personal data is the voluntary, specific, informed and unambiguous consent of the User expressed through the relevant form on the Website.
4. Personal data may also be processed in cases where the Administrator is authorised to process personal data on the basis of legal provisions or for the purpose of fulfilling a contract concluded between the parties, as well as on the basis of a legitimate interest pursued by the Administrator. In particular:

The personal data provided to the Administrator by the User as part of the order form are processed for the purpose of performing the contract concluded through the Shop or the Website. This contract is the legal basis for the processing (Art.6(1)(b) RODO). The provision of personal data by the User is voluntary but necessary for the User to conclude a contract with the Administrator. The data will be processed for the duration of the contract and the fulfilment of statutory obligations incumbent on the Administrator (e.g. tax and accounting), as well as in the event of claims.

  The personal data provided to the Administrator by the User within the newsletter sign-up form are processed in order to send the User a newsletter containing information on news and selected offers. The provision of personal data by the User is voluntary, but necessary in order for the User to subscribe to and receive the newsletter. The processing of the data for this purpose is carried out only with the User’s consent (legal basis Art.6(1)(a) RODO), which can be expressed by the User in the newsletter subscription form and can be revoked at any time. The data will be processed until the newsletter is no longer sent or the User has previously withdrawn consent.

    Personal data provided to the Administrator by the User within the contact form or in an email sent to the Administrator’s address provided on the Website shall be processed in order to respond to the enquiry sent. The provision of personal data by the User is voluntary, but necessary for the User to receive a response. The processing of data for this purpose is carried out on the basis of the legitimate interest pursued by the Administrator (Art.6(1)(f) RODO). The data will be processed until the correspondence is completed and 3 years afterwards.

    Personal data provided to the Administrator by the User within the comment/opinion form is processed in order to display the User’s comment/opinion. The provision of personal data by the User is voluntary, but necessary for the User to be able to post a comment/opinion. The processing of the data for this purpose takes place on the basis of the User’s consent (legal basis art.6(1)(a) RODO). The data will be processed for as long as the Website exists or until the User withdraws consent

• The Administrator may entrust personal data to other entities with the help of which it fulfils the purposes indicated in the preceding paragraphs (e.g. companies providing hosting services, an accounting firm, courier companies, a company providing an emailing application).
• The User’s personal data will not be transferred to recipients from third countries or international organisations that do not provide an adequate degree of protection. An adequate degree of protection must be confirmed by a relevant decision of the European Commission or other binding legal instrument.
• The Administrator guarantees the confidentiality of any personal data provided to it.
• Personal data shall be collected with due care and shall be adequately protected against access by unauthorised persons, and shall be processed in accordance with and under the conditions set out in detail in:
  • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC,
  • act of 18 July 2002 on the provision of services by electronic means,
  • the Act of 10 May 2018 on the protection of personal data.

§3 User rights

1. The user has rights related to the processing of his/her personal data, including:

3. the right to rectify your data
4. the right to restrict processing
5. the right to object to the processing of your Data
6. the right to erasure of your data (so-called right to be forgotten)
7. right to data portability
8. the right to lodge a complaint with a supervisory authority in relation to the Administrator’s processing of personal data
9. The User has the right to withdraw his/her consent at any time if the User has previously given his/her consent.

§4 Cookies and other information

1. When the User uses the Website, data concerning the User is automatically collected. This data includes, but is not limited to: IP address, domain name, browser type, operating system type. This data may be collected by cookies and may also be recorded in server logs.
2. Cookies (so-called “cookies”) are files sent to the User’s computer or other device (e.g. laptop, smartphone, tablet) and stored there while browsing the Website. Cookies remember the User’s preferences and behaviour, which makes it possible to improve the quality of the services provided, to improve search results and the relevance of the information displayed, including advertisements, and to track the User’s preferences anonymously. An up-to-date list of the cookies used on the Website is available via the cookie bar provided on the Website.
3. The User may give his/her consent to the use of cookies on his/her terminal device via the cookie bar provided on the Website. He or she may also do so through the settings of the browser installed on the User’s device. In the same way, the User may withdraw his/her consent or change its scope at any time.
4. The User may also delete existing cookies from his/her device, using the relevant functions of the browser, the programs used for this purpose or the tools available within the operating system used by the User.
5. The data stored in server logs or by means of cookies are not linked by the Administrator in any way with specific Website Users and are not used by the Administrator to identify the User. Server logs are used for the administration of the Website and their contents are not disclosed to anyone other than those authorised to administer the server.
6. The Website uses technologies that record anonymously the actions taken by the User when using the Website. These include:
   1. Google Analitysc – used to analyse the statistics of the Website
   1. Facebook Pixel – used to manage and optimise Facebook advertising
7. The data obtained by these tools are not linked in any way with specific Website Users and are not used by the Administrator to identify the User.
8. The consequence of using the technologies listed in § 3 para. 7 will be to optimise the Website, its content and the Product offering to the User’s needs.

§5 Purpose of data use

The Administrator uses the data provided by the User or collected automatically in order to:

1. proper functioning, configuration, security of the Website,
   1. monitor the status of the session,
   1. analyses, research and audit of the Website’s displays,
   1. performance of agreements concluded through the Website
   1. as well as for statistical and marketing purposes.

§6 Final provisions

1. This document may be subject to change as a result of developments in internet technology, changes in data protection law and the development of our Website and Shop. Any changes will be communicated to Users immediately in a visible and understandable manner.
